Landlord sued by tenant who jumped out of second story window to escape fire in adjacent apartment

fire_alarmGRETNA – A Jefferson Parish woman is suing her landlord after claiming she was injured after she jumped from her second story window when her neighbor’s apartment caught on fire.

Marion Garcia filed suit against Mo-Town Investments LLC in the 24th Judicial District Court on April 29.

Garcia claims she was in her apartment located at 810 5th St. in Harvey owned by Mo-Town Investments when the apartment beneath hers caught fire. The plaintiff alleges she had to escape the blaze by jumping out of the second story window, which resulted in painful and serious personal injuries.

The defendant is accused of failing to maintain the rental property in a reasonably safe condition, failing to keep rental property safe for tenants, failing to learn of a dangerous and defective conditions, failing to warn tenants of said dangerous and defective conditions, failing to properly install fire extinguishers, failing to properly install automatic fire extinguishers, failing to properly install fire and smoke detectors and failing to properly install adequate emergency lighting.

An unspecified amount in damages is sought for pain and suffering, permanent damage, loss of enjoyment of life, medical expenses and loss of income.

Garcia is represented by Gretna-based attorney Pierre F. Gaudin.

The case has been assigned to Division O Judge Ross P. LaDart.
